Abstract: This article compares Belgium and France as to their constitutional procedure's respecting the Melki judgment. The birth of constitutional review and diffuse human rights review in both jurisdictions is compared, both jurisdictions' stance on the hierarchy between the Constitution and EU law is discussed, the Melki judgment is explained, and the constitutional review procedures are discussed in the light of this jurisprudence. Subsequently, the Melki jurisprudence itself is subjected to criticism, because it allows for the full effect of constitutional review and the full effect of human rights to be downsized in favour of the full effect of EU law.
