Abstract: This article considers key intellectual property issues
arising in the context of escalating nanotechnology
patents. Patent thickets, a problematic aspect of patenting
essential nanotechnology research, are examined
in the first part, together with a related discussion
on patent trolls. Viable options for addressing such
difficulties are then explored in the second part. These
include the creation of patent pools and the extent
to which an open source model can be applied to
nanotechnology research.
