Abstract: This article confronts European data protection legislation with the outcome of the political negotiations between the European Commission and the U.S. Department of Homeland Security (DHS) on the transfer of European air passengers' personal data to U.S. authorities. The author demonstrates that these transfers violate European data protection legislation on several points. The commitments made by the DHS as a result of the negotiations are definitely insufficient to offer a sound legal basis for the transfer of passengers' personal data.
