Abstract: In elderly care and geriatrics one is confronted with the limited ability to give consent of the resident or the patient. This can be the case with beginning forms of dementia. The answer to the question what choice can be made, is to be approached in two steps: the medical reality has to be introduced after which the ethical counselling can start. In the ethical discussion the distinction can be made between the negative and the positive freedom. In the first form of freedom, the attention is focused on the estimation of the competences of the inhabitant or the patient; in the second form on the responsibility of the care giver.
